Directorate of Labour Service

The functions are:

The Directorate of Labour Services mandate is to promote harmonious labour and industrial relations by protecting the national workforce from unfair Labour practices and unsafe working conditions.

Ensure adherence with the provisions of the Labour Act, 2007 (Act No 11 of 2007), as well as Regulations Relating to the Health and Safety of Employees at workplace through advocacy and enforcing compliance.

Contribute to industrial peace and to the balanced socio-economic development of the country through the provision of effective and efficient Labour inspection services and educates and advises employers and employees on their obligations and right in terms of the Labour Act.

The Directorate comprises of two Division namely; Labour Inspectorate and Occupational Safety and Health (OSH)

The Directorate is also mandated, in terms of Employee Compensation Act, 1941 (Act 30 of 1941), to cover for government employee compensation, who sustained injury or contracted occupational disease in line of duty.

Division: Occupational Safety & Health (OSH)

Occupational Safety and Health Division mandate is to ensure adherence and enforcing compliance to the provision of the Labour Act, 2007 (No 11 of 2007) in respect of Health, Safety and Welfare of Employees, as well as Regulations Relating to the Health and Safety of Employees at Workplace.

 

Functions and Duties:

 

  1. Conduct safety and health workplace, including dangerous machinery compliance inspection to ensure maintenance of occupational safety and health standards.
  2. Conduct inquiry into workplace accidents  and OSH related complaints investigation
  3. Contribute to industrial peace and to the balanced socio-economic development of the country through the provision of effective and efficient labour workplace inspection and Dangerous machinery inspection and registration.
  4. Promotion of preventative culture to minimize work related accidents and injuries and occupational diseases.
  5. Providing technical information and advice to social partners and other stakeholders on their obligations and right in terms of the OSH legislation.
  6. Approval and registration of  Factories
  7. Registration of Dangerous Machineries
  8. Registration of Approved Inspection Authorities (AIAs)

 

 

 

Division : Labour Inspectorate

Labour Inspectorate mandate is to ensure adherence and enforcing compliance to the provisions of the Labour Act, 2007 (Act No 11 of 2007) in respect of the basic conditions of employment and welfare of employees at workplaces, enforcement and execution of arbitration awards And implementation and enforcement of wage order and collective agreements.

 

 


Functions and Duties:

 

  1. Conduct Condition of employment workplace, including prohibition of child labour compliance inspection to ensure welfare of employee at workplace.
  2. Conduct investigation and mediate for harmonious resolution on Labour related complaints
  3. Contribute to industrial peace and to the balanced socio-economic development of the country through the provision of effective and efficient labour workplace inspection.
  4. Enforcement and execution of Arbitration Awards
  5. Implementation and enforcement of wage order (Domestic workers) and sectoral collective agreements (Agriculture, Security and Construction).
  6. Providing technical information and advice to social partners and other stakeholders on their obligations and right in term of condition of employment and their welfare.
